Extensive experience conducting IP due diligence assessments for acquisitions, divestitures and strategic alliances, as well as freedom-to-operate, invalidity, and patentability assessments. Experience managing global trademark portfolios, including negotiating co-branding and co-existence agreements and conducting trademark clearance assessments for registration and use of target marks, logos and taglines. Experience managing IP litigation (including ANDA paragraph IV litigation), reexamination, IPR, invalidation, and opposition proceedings, including selecting and guiding Internal and External Legal Counsel.

What is an Interim or Fractional GC or Chief IP Counsel?:

An Interim or Fractional General Counsel or Chief IP Counsel refers to an arrangement where a company hires a part-time or temporary corporate counsel rather than a full-time, in-house counsel. The term “interim” or “fractional” in this context implies that the legal professional’s time commitment is a fraction of what a full-time GC or Chief IP Counsel would typically dedicate to a single company.

This arrangement is often suitable for smaller or growing businesses that may not require a full-time legal executive but still need legal expertise and advice on a regular basis. Fractional general counsels are usually experienced attorneys or legal professionals who work on a contract or consulting basis.

The interim or fractional general counsel may handle various legal matters for the company, such as contract review and negotiation, compliance issues, risk management, and general legal counsel. This approach allows companies to access legal expertise without the cost and commitment associated with hiring a full-time General Counsel or Chief IP Counsel.
